Terms of Service

The terms that govern your use of EUProof GPSR documentation software: accounts, billing through Polar, what the documents are and aren't, fair use, and liability.

1. Agreement

By creating a EUProof account or using the service, you agree to these Terms of Service. If you do not agree, do not use the service.

2. Service description

EUProof is a web application that helps sellers generate documentation related to the EU General Product Safety Regulation (Regulation (EU) 2023/988, "GPSR"). You add a product, answer guided questions, and EUProof produces draft documents such as a risk assessment, a technical documentation file, a Declaration of Conformity, and multi-language safety warnings.

EUProof is a documentation tool. It is not a law firm, it does not provide legal advice, and it does not act as your EU Responsible Person or authorized representative. Documents are generated from the information you provide, and you are responsible for their accuracy and for deciding whether they meet your obligations.

Plans, prices, and feature limits are described on the pricing page. We may change features and pricing with reasonable notice.

3. Accounts

You are responsible for keeping your credentials secure and for all activity on your account. Notify us promptly at security@euproof.com if you suspect unauthorized use.

4. Billing and subscriptions

Paid subscriptions are billed through Polar Software Inc. ("Polar"), which acts as the merchant of record for these transactions. Polar collects payment, issues receipts, and remits applicable taxes and VAT on our behalf.

Subscriptions renew automatically at the end of each billing period at the then-current price unless cancelled. You may cancel at any time from Settings or via the Polar customer portal; cancellation takes effect at the end of the current period.

Refunds are governed by our Refund Policy.

5. Fair use

Plans include reasonable usage limits to protect the service. We may rate-limit or temporarily suspend accounts that abuse the service through automated scraping, mass account creation, malware, or other behavior that degrades service for other users.

6. Your content

You retain all rights to the product information and documents you create in EUProof. You grant EUProof a limited license to process that content solely to provide the service to you.

You are responsible for ensuring that the product information you enter is accurate and complete, and that you have the right to use it.

7. Documents and no legal advice

EUProof builds draft documents from the answers you give. It does not verify your products, inspect them, or test them, and it cannot confirm that your products are safe or that your documents satisfy GPSR or any other law.

A formal EU Declaration of Conformity is a legal requirement only for products covered by specific EU harmonisation legislation (for example CE-marked toys or electronics). For other consumer products, the Declaration of Conformity EUProof generates is a self-declaration of compliance with the GPSR that marketplaces and buyers often request. It is not a substitute for any conformity assessment, CE marking, or testing that harmonised legislation requires for your product.

If you are established outside the EU, the GPSR (Article 16) requires an economic operator established in the EU, a Responsible Person, to be named for your products before they are placed on the market. EUProof does not perform that role. Appointing a Responsible Person is your responsibility.

Nothing EUProof produces is legal advice. We are not your Responsible Person. For products in higher-risk categories, or where you are unsure, consult a qualified compliance professional or a reputable EU Responsible Person provider.

8. Prohibited use

You agree not to use EUProof to: violate any law, infringe intellectual property rights, attempt to access another workspace's data, reverse-engineer the service, or upload content that contains malware. You agree not to enter false product information or misrepresent documents generated by the service as independently certified.

9. Termination

You may delete your account at any time. We may suspend or terminate accounts for material breach of these terms. Outstanding subscription fees remain payable through the end of the period.

10. Disclaimers

EUProof is provided "as is." We do not warrant that the service will be error-free or uninterrupted.

EUProof generates draft documents based on the information you provide and on its reading of GPSR requirements as of the last updated date. We make no warranty that any document will be accepted by a marketplace, an authority, or a court, or that it will satisfy your obligations under GPSR or any other regulation.

You are responsible for reviewing every document, confirming it fits your product and markets, and keeping it up to date as the regulation and your products change.

EUProof does not provide legal advice and does not act as an EU Responsible Person.

11. Limitation of liability

To the maximum extent permitted by law, EUProof's aggregate liability is limited to the amount you paid for the service in the twelve months preceding the claim.

12. Consumer right of withdrawal

EUProof is sold to businesses. If you nonetheless qualify as a consumer in the EU or EEA, you have a statutory 14-day right of withdrawal from a distance contract under Directive 2011/83/EU.

EUProof is a digital service that starts immediately. By starting to use a paid subscription during the withdrawal period, you expressly ask us to begin performance right away and acknowledge that you lose the right of withdrawal once the service has been fully performed. This does not affect the 14-day refund described in our Refund Policy, which we offer to everyone regardless of status.

13. Governing law

These terms are governed by the laws of the jurisdiction in which the EUProof operating entity is established, and the competent courts of that jurisdiction have exclusive jurisdiction over any dispute.

If you are a consumer, this choice of law and forum does not deprive you of the protection of any mandatory consumer law of your country of residence.

14. Changes

We may update these terms; material changes will be communicated by email or in-app notice. Continued use after the effective date constitutes acceptance.
